Yes, a Resource Protection Area (RPA) designation is need for 8900 Oak Lawn St. The RPA is a 100ft buffer on any perennial streams and the connected wetlands that needs to remain in a natural state (not a buildable area) to protect water quality through the Chesapeake Bay Act. Attached is the 3-page RPA designation application. The RPA designation is a site-specific determination that needs to be completed by an environmental consultant and have the property owners’ signatures on page two. Any wetlands and streams need to be evaluated on the property. Attached is our list of wetland expert list or asking your land surveyor for recommendations is a good place to start. Because your lot was plated before 1989, it is considered a pre-bay lot (lots prior to 1989 before the Chesapeake Bay Act). This would allow a 50ft landward encroachment into the RPA to build a house. However if you are planning to split the parcel into two lots that would be considered new development and would lose the pre-bay lot status because it would be creating a new parcel. Either way- first the RPA line needs to be established. Once the RPA is established, we can work on the encroachment process if needed.
